Welcome to ColorGenPro! These Terms of Service ("Terms") govern your use of ColorGenPro's AI-powered coloring page generation service (the "Service"). By using the Service, you agree that these terms become a legally binding agreement between you and Avinuity Web Properties LLC ("ColorGenPro," "we," "us," or "our").
ColorGenPro is an AI-powered platform that allows you to generate custom coloring pages. When you use the Service, you can create text prompts that our AI will use to generate unique coloring page designs ("Designs"). You may also upload your own images or reference materials ("User Content") to help guide the AI generation process.

Age Requirement: You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

Your use of the Service, your User Content, and your Designs must comply with our Acceptable Use Policy. If you violate our Acceptable Use Policy, we may delete or restrict the violating content, suspend or terminate your account, or take other appropriate action.

Your Content: You represent and warrant that you own all rights to any User Content you upload or that you have secured all necessary rights to use it as contemplated by these Terms. You retain ownership of your User Content.
You grant ColorGenPro a limited license to use, store, and process your User Content solely to provide the Service to you, including generating your Designs and keeping the Service secure.
AI-Generated Designs: Designs created using the Service are generated by AI based on your prompts and inputs. While you may use your Designs for personal or commercial purposes (subject to your subscription level), you acknowledge that AI-generated content may have limitations on copyright protection under applicable law. We make no warranties about the copyrightability of AI-generated Designs.
AI Training: We may use anonymized usage data to improve our AI models and Service. We will not use personally identifiable information for AI training without your consent.
Credits: The Service operates on a credit-based system. Each generated coloring page costs credits as specified in your subscription plan or credit purchase.
Subscriptions: If you purchase a subscription, it will automatically renew each billing cycle (monthly or annually) unless you cancel. We will notify you before auto-renewal. You can cancel your subscription at any time through your account settings.
Pricing: Pricing is based on the billing information you provide at the time of purchase and may vary by location.
Refunds: Our refund policy is detailed in our Refund Policy, which includes a 14 Days Money Back Guarantee for eligible first-time purchases.
Taxes: Your subscription fees and credit purchases are inclusive of all applicable taxes unless otherwise specified. Tax rates are calculated based on your billing information.
Cancellation: If you cancel your subscription, it will remain active until the end of your current billing period. You will not receive a refund for fees already paid (except as provided in our Refund Policy).
Free Credits: ColorGenPro may offer free credits to new users or as promotions. We reserve the right to set eligibility requirements and expiration dates for free credits.
Price Changes: We may change our prices at any time. For existing subscriptions, price increases will not apply until your next renewal or 30 days after notice, whichever is later.
Except as expressly stated in these Terms, all intellectual property rights in the Service remain the sole property of ColorGenPro and its licensors. You may not copy, modify, reverse-engineer, or create derivative works of the Service.
If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without any obligation to you.

THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLORGENPRO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that generated Designs will meet your specific requirements. We are not responsible for data lost or altered during transmission over networks we do not control.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLORGENPRO'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO COLORGENPRO IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
COLORGENPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
These limitations do not apply to liabilities that cannot be excluded under applicable law.
You agree to indemnify and hold harmless ColorGenPro from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Term: These Terms take effect when you first access the Service and continue until your account is terminated.
Termination by You: You may stop using the Service and delete your account at any time.
Termination by Us: We may suspend or terminate your account if you violate these Terms or our Acceptable Use Policy. Upon termination for cause, you will not receive a refund and must immediately pay any outstanding fees.
Effect of Termination: Upon termination, you will lose access to your account, Designs, and User Content. We may delete all your data unless legally prohibited. You should download any Designs you wish to keep before termination.
We may modify these Terms at any time. We will post the most current version on our website and provide reasonable advance notice of material changes via email or through the Service. By continuing to use the Service after revised Terms become effective, you agree to the new Terms.
We may add, modify, or remove features from the Service at any time. If we discontinue the Service during an active paid subscription, we will provide a pro-rata refund for the unused portion of your subscription.
Governing Law: These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions.

If we cannot resolve the dispute directly, you and ColorGenPro agree to resolve any claims through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except for claims seeking injunctive relief.
All claims must be brought individually, not as part of a class action. By agreeing to these Terms, you waive your right to a jury trial and to participate in class actions.
Entire Agreement: These Terms constitute the entire agreement between you and ColorGenPro regarding the Service.
Assignment: You may not assign these Terms without our written consent. We may assign our rights and obligations at any time.
Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.

Export Compliance: You agree to comply with all applicable export and import laws and regulations in your use of the Service.
